According to the new requirements of the Turkish Notary Association, real estate leases in the statutory format are no longer mandated, and employment transfer agreements do not have to receive stamp taxes. Before these changes, public notaries were enforcing these requirements in an inconsistent way, so the Association is attempting to clear up any misunderstandings.
Having decided that lease agreements are only subject to fixed fees and are not considered commercial agreements, the notary group has removed the stamp tax requirement. Additionally, lease agreements in statutory form are no longer necessary for the registry of real estate; as long as the agreements are in writing, the notary public association takes no issue with them.
